1. Agreement to Terms

By accessing or using Call Me Alibi ("Call Me Alibi", "Service", "we", "us", or "our"), a product of Coda Tech LLC, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you do not have permission to access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Call Me Alibi is a mobile application that provides:

• Simulated incoming phone calls with realistic AI-powered voice conversations
• Multiple caller personas (e.g., Mom, Boss, Friend)
• Scheduled and on-demand call triggering
• Native iOS call experience using CallKit

Call Me Alibi is designed as a personal safety tool to help users exit uncomfortable or potentially unsafe situations by providing a believable reason to leave.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. Intended Use

A. Safety Tool

Call Me Alibi is intended for personal safety purposes, including but not limited to:

• Exiting uncomfortable social situations
• Creating a reason to leave potentially unsafe environments
• Providing peace of mind in unfamiliar settings

B. Prohibited Uses

You agree NOT to use Call Me Alibi for:

• Harassment, stalking, or intimidation of others
• Fraud, deception for financial gain, or any illegal activity
• Evading law enforcement or interfering with legal proceedings
• Any purpose that violates local, state, national, or international law
• Creating false emergencies or wasting emergency services resources

We reserve the right to terminate accounts and refuse service to anyone using Call Me Alibi for prohibited purposes.

4. Account Registration and Data Storage

A. Account Creation

Call Me Alibi can be used without creating an account. If you choose to create an account for premium features, you acknowledge that Call Me Alibi uses Sign in with Apple for authentication. We do not store or manage your passwords.

B. Age Requirement

You must be at least 13 years old to use the Service. We reserve the right to refuse service or terminate accounts at our sole discretion.

C. Data Storage

You acknowledge and agree that:

• Your preferences and settings are stored locally on your device
• Conversation audio is processed in real-time and is not recorded or stored
• No transcripts of your conversations are created or retained
• Call history is managed by iOS, not by Call Me Alibi

5. Subscriptions and Billing

A. General

The Service may offer paid Subscriptions processed through the Apple App Store ("Apple"). These purchases are subject to Apple's terms and conditions.

B. Billing

You agree to pay the Subscription fees. All billing and transaction details are handled by Apple. We do not collect or store your credit card details or billing information.

C. Automatic Renewal and Cancellation

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. To avoid charges, you must manage or cancel your Subscription directly through your Apple ID Account Settings.

D. Free Trial

If offered, free trials automatically convert to paid subscriptions unless canceled before the trial period ends. You can cancel at any time through your Apple ID Account Settings.

6. Acceptable Use

You agree to use Call Me Alibi only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to the Service or its related systems or networks
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to harm, threaten, or harass any person
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity

7. Intellectual Property

All intellectual property rights in the Service (including software, technology, content, AI personas, and the "Call Me Alibi" name) are owned by Coda Tech LLC. You are granted a limited, non-exclusive, non-transferable license to use the Service on your personal device solely for its intended purpose.

You may not:

• Copy, modify, or distribute the Service or any part thereof
• Use our trademarks without prior written consent
• Create derivative works based on the Service

8. AI and Voice Technology Disclaimers

A. AI-Generated Content

The Service uses Artificial Intelligence (AI) to generate voice responses during fake calls. You acknowledge that:

• AI responses are generated in real-time and may vary
• The AI is designed to maintain a specific persona but may occasionally produce unexpected responses
• AI technology is not perfect and responses may not always be contextually ideal

B. Third-Party AI Services

Call Me Alibi uses ElevenLabs for AI voice generation. Your use of the Service is also subject to ElevenLabs' terms and acceptable use policies. You agree not to attempt to misuse, exploit, or circumvent the AI systems.

C. No Guarantee of Outcomes

While Call Me Alibi is designed to help you exit uncomfortable situations, we cannot guarantee any specific outcome. The effectiveness of the Service depends on many factors outside our control.

9. Privacy

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any situation or outcome resulting from your use of a fake call
• The actions of any person who may observe or overhear your use of the Service
• Any technical failures, including but not limited to network issues, AI service outages, or device malfunctions

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Coda Tech LLC expressly disclaims all warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• That the Service will be uninterrupted, secure, or error-free
• That AI responses will always be appropriate or convincing
• That the Service will be effective in any particular situation

12. Indemnification

You agree to defend, indemnify, and hold harmless Coda Tech LLC and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from:

14. Dispute Resolution

A. Informal Resolution

Before filing any formal dispute, you agree to first contact us at codatech@icloud.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

B. Binding Arbitration

If informal resolution fails, any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the commercial rules of the American Arbitration Association, except where prohibited by law.

C. Waiver of Class Actions

You and Coda Tech LLC agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You waive the right to participate in class actions or class arbitrations.

You may stop using the Service at any time by deleting the app from your device.

B. By Us

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms or for any other reason at our sole discretion.

C. Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
